Terms of Service

for credit card transactions

In consideration of the mutual covenants herein contained, Client, hereinafter called "Sponsor" engages the services of Awesome Entertainment, hereinafter called "Agent", to provide entertainment according to the terms and conditions set forth with this agreement. It is understood that the Entertainer(s) shall have exclusive control over the means, method and details of fulfilling Agent's obligation under this contract, except for the Event Date & Times set forth by Sponsor. Entertainer(s) may end performance at any time if any person(s) is perceived to be at risk of personal injury - or- any property is at risk of damage. Sponsor agrees to furnish suitable weather protection, parking or other equipment needed to complete the job. If engagement is not presented due to circumstances no under the control of Entertainer(s), including but not limited to Sponsor canceling or postponing event, bad weather, rain, snow, high winds or any other reason, and Entertainer(s) is ready, willing and able to perform, Entertainer(s) is to be paid in full. Agent assumes no liability in connection with this engagement or liabilities caused by failure of the Entertainer(s) to appear or perform except, however, should Entertainer(s) fail to appear for any reason other than Sponsor canceling event .Agent agrees to return to Sponsor any payments paid to Agent. Your online payment is not refundable. Sponsor will indemnify, defend, and hold the Agent (and all representatives) harmless from all actions, proceedings, claims, demands, liabilities, losses, judgments, damages, penalties, or expenses, of whatever kind, including interest, attorney fees, court costs, and other reasonable costs and charges resulting from the negligence of intentional misconduct of the Sponsor or third parties involved with or present at the event, including guests and venue staff. This instrument constitutes the entire agreement between both parties, and may not be enlarged, altered or modified, except in the form of a revised typed agreement. No hand-written changes or e-mail changes will be valid. Any controversy or claim relating to this contract, or breach thereof, shall be settled in Canyon Lake, CA jurisdiction.

Sponsor is acknowledging that they have read, understand and agree with the Awesome Entertainment Terms of Service by authorizing their credit card as payment.
